Hours attached to payment claims
Updated
The Construction Contracts Act 2002 gives subcontractors a statutory payment claim process. A claim must be in writing and state how the claimed amount was calculated. For labour billed by the hour, the hours summary is the core of that calculation.
What a payment claim must contain
- Be in writing and state that it is made under the Construction Contracts Act 2002
- Identify the construction contract and the period the claim covers
- Identify the work done in the period
- State the claimed amount and the due date for payment
- State how the amount was calculated
The payer's response
A payer who disputes the amount must issue a payment schedule within the contractual or statutory period, stating the amount it will pay and the reasons for any difference. Without a schedule in time, the claimed amount becomes payable.
Why attach hours
Where labour is charged by the hour, the calculation is the list of people, days, hours and rates. A summary by site and period reduces disputes about the amount and provides evidence if one arises.
Suggested attachment format
- Summarised by site and claim period, with paid hours per person per day
- Totals, rates and amounts that match the claim itself
- Arrival time and site for each record, with the edit history where relevant
In Hatplan
- Hours summaries export by site and pay period with paid hours per person per day
- Each record carries its location, geofence result and edit history, ready to attach
- Subcontract crews logged for presence only export their days and times the same way
